I concur with the verdict but not with the reasoning: Justice Azmat Saeed
ISLAMABAD, APR 13 (DNA): Justice Sheikh Azmat Saeed has said that he agrees to the disqualificaion verdict announced by the five-member Supreme Court bench under Article 62 (1)(f), but not with the reasoning employed in the case.
In an additional note with the judgement, he wrote: “I concur with the conclusions drawn in the said judgment but I do not find myself in agreement with reasoning employed in its entirety.”
“Article 62 (1)(f) is rooted in our Islamic values and the provision should be interpreted with utmost care. The attorney general’s stance was right that the mater should be resolved by parliament. The court can interpret constitutin, but not amend or add something to it,” he wrote in eight-page additional note.
He said that the court had declared it more than once that disqulification under Article 62 (1)(f) would be for life. “Unless there is the verdict, the person in question would remain disqualify.”
“According to some lawyers, disqualification for life is a strict decision. But this argument is better for Majis-e-Shoora as it could not decide on the duration of disqualification,” he added.
